Atlanta DOL Nabs Contractor for Misclassifying Independent Contractors
The Atlanta DOL isn’t messing around. Not only did the agency secure nearly $100k in back wages for some painters who were misclassified as independent contractors, it also has a web page where workers can enter their info to see if they qualify for back pay.

The Department of Labor in Atlanta determined a painting contractor incorrectly classified 32 painters as independent contractors and paid them straight-time rates for all hours worked. The contractor denied workers their overtime wages, violating the Fair Labor Standards Act.
The DOL recovered $87,333 in back wages for the painters. “Ensuring proper classification of employees is not just about compliance,” said Wage and Hour Division District Director Steven Salazar in Atlanta. “Misclassifying workers as independent contractors strips them of their rightful benefits and protections. Workers are entitled to the full extent of compensation and benefits afforded by law. We urge employers who do not understand the requirements to stay compliant with the laws to reach out to our office for answers.”
The Georgia DOL says it has recovered more than $2.2 million owed to 7,000 workers. People can access the agency’s website to see if they are owed back wages collected by the agency.
